Katy (Kathryn) McClure has worked as an employment paralegal and attorney since 1995. Ms. McClure concentrates her practice in the representation of employees in claims including discrimination, harassment, retaliation and reasonable accommodations under state and federal law. Ms. McClure has achieved substantial results for her clients including a $1.1 million judgment in a three-employee pregnancy discrimination case and $220,000 settlement in a whistle blower case.
A former full-time employment paralegal who attended law school at night, Ms. McClure credits her work/school experience for instilling in her the tenacity, judgment and dedication which she brings to bear as an advocate vindicating the rights of individuals who have suffered injustice in the workplace. Ms. McClure’s practice encompasses all areas of employment law including discrimination and harassment on the basis of sex, age, race, disability, national origin, sexual orientation, marital status, disability, pregnancy and domestic partnership. She regularly represents clients in claims arising under New Jersey’s whistleblower law, the Conscientious Employee Protection Act (CEPA), and the New Jersey Law Against Discrimination (LAD).
Ms. McClure also counsels and advises employees with regard to various employment matters including requests for reasonable accommodations for a disability or pregnancy, the interactive process, Family Medical Leave Act and the New Jersey Family Leave Act. She also regularly reviews and advises clients regarding employment agreements including employment contracts, non-compete/non-solicitation agreements, and severance agreements.
Ms. McClure is President of the New Jersey affiliate of the National Employment Lawyers Association (NELA-NJ). Ms. McClure recently appeared as amicus curiae on behalf of NELA-NJ in Acevedo v. Flightsafety Int’l, Inc., 156 A.3d 183 (App. Div. 2017), in which the Appellate Division held that unemployment compensation benefits may not be deducted from back pay awards in LAD cases.
In May 2017, Ms. McClure was elected to serve as Secretary to the New Jersey State Bar Association’s Labor & Employment Section Executive Committee. Ms. McClure also currently serves as Coordinator of the Section’s Social Media and Website Committees.
Ms. McClure is a Barrister of the Sidney Reitman Employment Inn of Court, which awarded her the David Solomon Award for Outstanding Service to the Inn in 2013. She has lectured for ICLE, the New Jersey Association for Justice, and other organizations, and is the author and co-author of articles which have appeared in the New Jersey Law Journal and New Jersey Labor and Employment Law Quarterly, including Stemming the Tide: The Appellate Division Shores Up CEPA Protection for Whistleblowers Doing Their Job and What to Expect When Your Employee is Expecting: How the LAD’s Pregnancy Amendment Impacts the Employer-Employee Relationship.
Ms. McClure received her B.A. from Montclair State College and her J.D. from Rutgers School of Law-Newark, where she was the recipient of the Myron Harkavy Award for greatest promise as a trial lawyer. She is also a former adjunct professor at Montclair State University, where she taught legal research to undergraduate students. We are happy to welcome Katy to our law firm.
